1. Definitions

By accessing or using the Peach platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

3. Eligibility and Age Requirements

• You must be at least 18 years old to use this Service

4. Service Description

Peach is a premium social platform that facilitates connections between content creators, models, and clients. The platform may contain adult content and services intended for mature audiences only.

5. User Accounts and Registration

5.1 Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining account confidentiality
• You must notify us immediately of any unauthorized use
• One person may not maintain multiple accounts

5.2 Account Types

• Models/Creators: Users who provide services or content
• Clients: Users who engage with creators and purchase services
• Admin: Platform administrators with additional privileges

5.3 Verification Requirements

• Identity verification may be required for certain features
• KYC (Know Your Customer) procedures may apply
• Age verification is mandatory for all users

6. Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purposes
• Upload content depicting minors in any context
• Share personally identifiable information of other users
• Engage in harassment, abuse, or threatening behavior
• Distribute malware, viruses, or harmful code
• Attempt to circumvent security measures or gain unauthorized access to the Service, servers, or connected systems
• Create fake profiles or impersonate others
• Engage in spam, fraud, or deceptive practices
• Use automated tools, bots, scrapers, or crawlers to access the Service or collect data without our written permission
• Scrape, harvest, or mine data from the Service or its users
• Violate intellectual property rights
• Interfere with or disrupt the Service or its infrastructure

7. Content Guidelines

7.1 User-Generated Content

• You retain ownership of User Content you create and upload
• By submitting User Content, you grant Peach a worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, store, display, distribute, and promote your User Content solely for the purposes of operating, improving, and marketing the Service
• You confirm you have all necessary rights, permissions, and consents to submit your User Content
• Content must comply with local laws and platform guidelines
• Peach reserves the right to remove content that violates these Terms

7.2 Prohibited Content

• Content involving minors (anyone under 18)
• Non-consensual intimate content
• Content promoting illegal activities
• Copyrighted material without permission
• Content that violates third-party rights

7.3 Promotional Use and Third-Party Platforms

• Public User Content (such as profile photos and public posts) may be featured in platform marketing, social media, and promotional materials
• User Content may appear on third-party platforms through search engine indexing, social media embeds, or content delivery networks
• You will not receive additional compensation for promotional use of public User Content

7.4 Content Removal and Withdrawal

• You may delete your User Content at any time through the platform
• Upon deletion, we will take reasonable steps to remove content from channels we control
• We cannot guarantee removal of content already cached, shared, or indexed by third parties
• Content may be retained where required by law or for legitimate dispute resolution

8. Intellectual Property

• The Service, including its design, features, code, logos, and original Content, is owned by or licensed to Peach and is protected by intellectual property laws
• You may not reproduce, distribute, modify, sell, or commercially exploit any part of the Service or its Content without prior written permission
• The Peach name, logo, and branding are trademarks of Peach and may not be used without authorization
• Nothing in these Terms transfers any intellectual property rights to you, other than the limited right to use the Service in accordance with these Terms

9. Payment and Financial Terms

9.1 Platform Fees

• Peach charges a percentage of transactions processed through the platform
• Fee structures are clearly disclosed before transactions
• Transaction charges imposed by banks, mobile money operators, or payment gateways are your responsibility unless stated otherwise
• Users are responsible for applicable taxes

9.2 Payments and Refunds

• All payments are processed through secure third-party providers
• Refund policies are clearly stated for each service type
• Chargebacks and disputes are handled according to payment processor policies
• Where no specific refund policy is published for a service, fees are non-refundable

9.3 Creator Earnings

• Creators set their own rates for services
• Platform takes agreed-upon percentage of transactions
• Earnings are paid according to payout schedules
• Creators are responsible for tax obligations

10. Privacy and Data Protection

10.1 Data Collection

• We collect information necessary to provide the Service
• Collection practices are detailed in our Privacy Policy, which forms part of these Terms
• Users may request data deletion subject to legal requirements

10.2 Data Security

• We implement industry-standard security measures
• No system is 100% secure; users should protect their own information
• Data breaches will be reported according to applicable law

11. Service Availability

• We may update, modify, suspend, or discontinue any part of the Service at any time for operational, security, or maintenance reasons
• We do not guarantee uninterrupted or error-free access to the Service
• We are not liable for any downtime, delays, or temporary unavailability
• Scheduled maintenance will be communicated in advance where practicable

12. Disclaimers

• The Service and all Content are provided "as is" and "as available" without warranties of any kind, whether express or implied

• Interactions between users are at your own risk; Peach is a platform facilitating connections, not a party to arrangements between users

13. Limitation of Liability

• Peach's total liability for any claim related to the Service shall not exceed the amount you paid to Peach in the twelve (12) months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• We are not liable for any loss or damage arising from user interactions, User Content, or third-party services
• Some jurisdictions may not allow certain limitations; in such cases, liability is limited to the minimum extent permitted by law

14. Indemnity

You agree to indemnify and hold harmless Peach, its officers, directors, employees, agents, and partners from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

• Your breach of these Terms
• Your User Content
• Your misuse of the Service
• Your violation of any rights of another party
• Any activity conducted through your account

15. Suspension and Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if:

• You breach these Terms
• Your actions pose a security, legal, reputational, or operational risk to Peach or its users
• We are required to do so by law or a competent authority
• Your account is inactive for an extended period
• We reasonably suspect fraud, abuse, or misuse

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 7, 8, 12, 13, 14, and 16) will continue to apply.

16. Dispute Resolution

16.1 Governing Law

• These Terms are governed by Netherlands law
• Disputes will be resolved in Netherlands courts (Amsterdam jurisdiction)

16.2 Arbitration

• Certain disputes may be subject to binding arbitration under Netherlands Arbitration Institute (NAI) rules
• Class action waivers may apply where legally permissible

17. Changes to These Terms

• We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices
